NOTICE OF TRUSTEE'S SALE OF REAL PROPERTY GENERALLY KNOWN AS 43 COUNTRY LANE, TROY, VIRGINIA 22974 In execution of a Deed of Trust, the ("Deed of Trust") dated December 27, 2019, executed by the Borrower for the benefit of Lender and recorded as instrument number 190004007 in the Clerk's Office of the Circuit Court of Fluvanna County, Virginia default having been made in the payment of the indebtedness thereby secured by failure to pay the amounts due at acceleration and maturity, the duly appointed Trustee, after giving not less than fourteen (14) days due notice by certified mail to the owner of the real estate of the date, time, place and terms of sale, will offer for sale the real property generally known as 43 COUNTRY LANE, TROY, VIRGINIA 22974 and all improvements thereon (collectively, the "Property") at public auction to the highest bidder on: April 22, 2021 at 2:00 o'clock pm. On the front steps of the courthouse building of the Circuit Court of Fluvanna County, Virginia located at 70 Main St, Palmyra, Virginia 22963. The property is more particularly described as follows: All that certain lot or parcel of land, situated in the Palmyra District of Fluvanna County, Virginia, containing 1.002 acres, more or less, as shown on a plat entitled "The Leona Washington Property, Palmyra District, Fluvanna County, Virginia," made by Robert L. Lum, Certified Land Surveyor, dated August 10, 1978, and recorded in the Clerk's Office of the Circuit Court of Fluvanna County, Virginia, in Deed Book 144, page 721. Reference is hereby made to the said deed, plat and other records of the aforesaid Clerk's Office for a more particular description of the property. TAX MAP NO. #: 4-A-73 TERMS OF SALE: CASH or CASH EQUIVALENT This sale and conveyance of the described property will be made and is subject to the covenants, dues or assessments, restrictions, rights-of-way, easements, and other matters, if any, contained in the deeds and other land records forming the chain of title to the described property and matters visible upon the premises. This sale and conveyance is further subject to mechanic's (contractors and subcontractors) and materialmen's liens of record and not of record, if any such liens exist, and any other matters of record taking priority over the Deed of Trust being executed and above described, and subject to real estate taxes for the following year(s); prorated amounts from and after the date of sale for the year of 2021, a lien not yet due and payable. To the extent permissible by law, all bidders, including the successful bidder, waive and release the Trustee, the Noteholder, and their respective agents, successors and assigns from any and all claims such bidder or his successor and assigns may have now or in the future relating to the environmental condition of the Property and all other actions arising from or relating to the condition of the Property, including but not limited to any violation of federal, state and local laws, ordinances, or regulations affecting the use or condition of the Property. The information as to the status of record title and improvements on the above-described real property and all documents available to the Trustee may be examined by prospective purchasers at the Office of Morrison, Ross and Whelan, 31 Garrett Street, Warrenton, Virginia 20186, Monday through Friday between 9:00 a.m. and 5:00 p.m. A deposit of ten percent (10%) of the sale price, cash or certified or cashier's check shall be required to qualify as a bidder prior to the sale (except for the Noteholder). The successful bidder shall be required to pay the deposit to the Trustee at the time of sale, which deposit shall be credited to the bid price at settlement with the balance due at settlement. Settlement shall be held on or before fifteen (15) days from the date of sale at the office of the counsel for the Trustee, at 31 Garrett Street, Warrenton, Virginia 20186 or at such other location as may be mutually agreed upon. Time shall be of the essence with respect to the time of settlement. In the event of the failure of the successful bidder (purchaser) to complete settlement within fifteen (15) days after the date of the sale, in accordance with the terms of sale, the deposit shall be forfeited and applied to the costs of sale, including Trustee's fees, and the property shall be resold at the cost and expense of the defaulting purchaser. The balance of the purchase price shall be in cash or its equivalent at the time of settlement. The subject property and any improvements thereon shall be sold in "AS IS" "WHERE IS" condition without warranties of any kind. Real estate taxes shall be adjusted as of the date of sale. All costs of the conveyance, which shall be by special warranty, examination of title, recording charges, notary fees, settlement fees, including preparation of deed and grantor's tax thereon, etc., will be at the cost of the purchaser. The Trustee reserves the right: (1) to waive the deposit requirement; (ii) to extend the period of the time within which the purchaser is to make full settlement; (iii) to withdraw the property from sale at any time prior to the termination of the bidding; (iv) to keep the bidding open for any length of time; (v) to reject all bids; (vi) to postpone or set over the date of sale; and (vii) to determine the order of sale at the time of sale. In the event the Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, such notices of postponement or setting over will be in a manner deemed reasonable by the Trustee. The sale is subject to such additional terms as the Trustee may announce at the time of sale.
