Pender, Esq., on Petitioner's Motion to Proceed by Publication. The object of this action is the Petitioner, Christopher Apperson's Stepparent Adoption Petition to adopt the son of Kaila Apperson (Racey), Maddox Clifton Racey. It appearing to this Court that the birth father and Respondent, Steven M. Herrmann, whereabouts are unascertainable; that Petitioners have used diligence to locate and serve the Respondent without success, and the Sheriff of Rockingham County, Virginia has filed a Proof of Service stating that the process has be effectuated by posed service, it is ORDERED the Petitioner may effectuate service of processes by publication. This Order of Publication shall be published once a week for four successive weeks in a newspaper of general circulation in the County of Orange, Virginia. The Clerk of this Court shall post this Order at the front door of the courthouse and shall mail a copy of this Order to the respondent at the post office address given in the affidavit of the Petitioner filed herein. It is further Ordered that Respondent shall appear before this Court within ten days after due publication of this notice and do what is necessary to protect his interests herein if he so desires. The Clerk shall post a copy of this Order at the Orange County Circuit Court until such time as the Defendant's time to appear in this matter has expired.
