NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS April 30, 2021 City of Charlottesville 610 E. Market Street PO Box 911 Charlottesville, VA 22902 434-970-3182 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Charlottesville Redevelopment and Housing Authority. REQUEST FOR RELEASE OF FUNDS On or about May 17, 2021 the City of Charlottesville will authorize Charlottesville Redevelopment and Housing Authority to submit a request to the HUD Richmond Field Office PIH Program Center for the release of Housing Choice Project Based Voucher funds under Section 8(o) of the U.S. Housing Act of 1937, as amended, to undertake a project known as 1st Street South Apartments Phase IIA and IIB for the purpose of constructing 113 new residential units, 2 outdoor amenity spaces, a community center, and a management office located at 900-1000 South 1st Street Charlottesville, VA (parcel 260115000). The units are for affordable housing and will replace the existing outdated multi-family developments located within the larger parent parcel. The property will be disposed of and converted to mixed finance housing development, with a new ownership entity. This project will be using $37,735,922.00 in construction financing and permanent financing in non-HUD funds for development. A total of $898,560.00 in HUD sourced project-based vouchers for operations post construction will be used. FINDING OF NO SIGNIFICANT IMPACT The City of Charlottesville has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at City of Charlottesville, 610 E. Market St., Charlottesville, VA 22902 and may be examined or copied weekdays 8:30 AM to 4:30 PM. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Charlottesville certifies to HUD that Mr. Charles Boyles in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Charlottesville Redevelopment and Housing Authority to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Charlottesville's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Charlottesville; (b) the City of Charlottesville has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Mr. Robert Davenport, Director, at during the Pandemic until further notice.
